These Terms and Conditions of Service and Use of ”VHS TO DVD LTD” (the “Terms and Conditions“) are hereby made effective (VHSTODVDWALES.com” or “we” or “us” or “our“), and, without waiving or otherwise releasing any right or obligation under any prior terms and conditions of the use of “vhstodvdwales.com” hereby amend and restate any such prior terms and conditions.

In consideration of each member or customer’s (each, a “customer” or “you“) access to and use of the Site, we require every members and customer to act with integrity, to our rules for the Site, and to abide by these Terms and Conditions and each other rule, regulation or other policy of “VHS TO DVD LTD”.

GENERAL TERMS

Without limiting the generality of the foregoing or any other provision hereof, you acknowledge and agree, as follows:

1. Not to use the Site in any manner that is, or could reasonably be construed to be, in violation of these Terms and Conditions, fraudulent, misleading, malicious or discriminatory;
2. Not to take any action that could disable, overburden, or impair the operation or availability of the Site, such as a denial of service attack;
3. Not to engage in manipulative practices designed to obfuscate the true intent of your submissions to the Site, or to artificially generate traffic to another website;
4. Not to facilitate or encourage any violations of these Terms and Conditions;
5. Not to issue chargeback disputes against “VHS TO DVD LTD”.
6. Not to use patented, copyrighted, trademarked or other protected intellectual property without the written consent and authorization of the owner of such property;
7. Not to copy, distribute or disseminate the Site or any portion thereof, and not to transfer the Site, or any portion thereof, to another person or “mirror” the Site, or any portion thereof, on any other server;
8. Not to decompile or reverse engineer, or attempt to decompile or reverse engineer, the Site or any portion thereof; and
9. Not to take any other action that could result in any damage or disruption to the Site, or that could otherwise result in any liability, damages, costs or expenses on the part of “VHS TO DVD LTD”.

CONSENT ​

“VHS TO DVD LTD” may host in-person events from time to time. These events may be recorded and photographed for marketing and/or the production of educational content.

OUR TERMS

1. The Client hereby acknowledges and agrees that the video conversion procedure is neither foolproof nor perfect. Even though the diagnosis furnished by “VHS TO DVD LTD” to the Client may indicate a strong probability of a successful recovery outcome, Our professional assessment of the Client’s storage media cannot guarantee that any specific result will be attained. No warranty is stated or implied in any way as to the accuracy of the assessment provided by “VHS TO DVD LTD” or the timeliness thereof.
2. “VHS TO DVD LTD” shall have the exclusive professional determination as to the diagnostic assessment and the possible success rate at its’ sole discretion. “VHS TO DVD LTD” agrees to use all resources and technology available at any of VHS TO DVD LTD’s facilities and/or laboratories to attempt video conversion.
3. “VHS TO DVD LTD” does not guarantee that the converted videos will be in high definition/Good video quality. By using our services you agree that our video footage might not be of good picture quality, if

• Your tape recording is old
• Your recording is of poor quality
• If your video is shot from a faulty device
• If your footage is blurry, overexposed or grainy

4. The Client’s storage media upon arrival to our offices will remain secure during the diagnostic procedure according to the rigorous internal security controls implemented at its’ facilities.
5. If our professionals, are unable to obtain any footage from your device, we will try to contact you to explain the situation. We can’t be hold responsible if your media device doesn’t contain any footage or if it is corrupted.
6. The client hereby acknowledges and agrees that their playback device & software is compatible.
7. “VHS TO DVD LTD” guarantees to the Client that it will not disclose or deliver the storage media to any third parties unless specifically ordered to do so by any governmental, judicial, or administrative order, subpoena, discovery request, regulatory request or similar method. “VHS TO DVD LTD” warrants that it will use the storage media only for the purposes of fulfilling this work engagement. VHS TO DVD LTD’s staff and agents are trained to safeguard the privacy of the Client’s Data. “VHS TO DVD LTD” enforces a very strict internal policy which ensures absolute discretion to our data recovery clients.
8. The Client’s storage media or recovered footage shall only be released to those parties named in this legal declaration. Any parties not named herein cannot claim or be released the said storage media or recovered data. Authorized data release individuals may be added by contacting your Account Representative and requesting the addition be notated in our database.

THE CLIENT HEREBY AGREES THAT WE SHALL NOT BE LIABLE TO THE CLIENT FOR ANY VOIDED WARRANTIES BY THE STORAGE MEDIA MANUFACTURER OR BY ANY OTHER WARRANTY PROVIDER.

9. If the Client would like such accessories to be returned, the Client: (1) must notify our Dedicated Account Representative  and have confirmation of the request that these accessories be returned prior to beginning the data recovery diagnostic procedure; and (2) will be responsible for all return shipping and handling costs. The Client hereby agrees that, absent such notification, We shall not be liable to the Client for the disposal of any such items.

• No video recovery procedure is foolproof or perfect. Although the diagnosis furnished by “VHS TO DVD LTD” to the Client may indicate a strong probability of a successful data recovery outcome, Our professional assessment of the Video Media cannot guarantee that any specific result will be attained. The Client hereby agrees that no express or implied warranty, guarantee, or promise is created as to the accuracy of any aspect of the diagnostic assessment provided by us to the Client.

VIOLATION; TERMINATION OF ACCOUNT

​You acknowledge and agree that “VHS TO DVD LTD” may, in its sole discretion, cancel, suspend or terminate your account if you breach these Terms and Conditions. “VHS TO DVD LTD” may refuse, in its sole discretion, to permit any use of the Site, and may refuse to permit any person to access to the services.

Your Warranties

You agree to use the Site only for lawful purposes and only for your own personal, non-commercial use. You may not use the Site to transmit, post, download, distribute, copy, display publicly, store or destroy material (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, patent, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others, or (c) that is libelous, obscene, offensive, threatening, defamatory, abusive or hateful.

By submitting an order, you represent and warrant the following to “VHS TO DVD LTD”:

(a) no materials submitted to “VHS TO DVD LTD” are submitted in violation of any copyright laws;

(b) any materials submitted were either created by you, you have the right to permit “VHS TO DVD LTD” to perform duplication services, or you have the permission of the copyright owner to duplicate the submitted materials; and

(c) no materials submitted are libelous, obscene, offensive, threatening, defamatory, abusive, hateful, or otherwise violate state or federal law or the rights of a third party; and

(d) (i) you shall not violate, or encourage the violation of, the legal rights of others; (ii) intentionally distribute viruses, worms, Trojan horses, corrupted files, hoaxes, or other items of a destructive or deceptive nature; (iii) interfere with the use of the Site; (iv) alter, disable, interfere with or circumvent any aspect of the services provided through the Site; (v) grant multiple individuals access to an individual account other than via the delegation features provided within the Site; or (vi) create accounts assigned to business functions rather than to human beings for the purpose of sharing files within or outside of the Site. By submitting an order, you understand that “VHS TO DVD LTD” is relying on these representations.

CANCELLATIONS & REFUNDS

​Your account or service may be cancelled, subject to the terms hereof, at any time; provided that, as set forth above, no refunds will be issued if your account or other periodic fee-based service is cancelled prior to the end of the applicable period or term.

We do not allow any refunds, We only allow replacements in special circumstances, this means your item must be unused and in the same condition that you received it. It must also be in the original packaging. We only replace items if they are damaged or lost during shipping. If you need to exchange it for the same item, send us an email with proof that your item is damaged or when it is lost through no fault of your own within 30 days to get a replacement.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund. Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

MODIFICATIONS

“VHS TO DVD LTD” reserves the right to revise these Terms and Conditions at any time without notice. By using the Site, you are agreeing to be bound by the then-current version of these Terms and Conditions, and your continued use of the Site reaffirms your agreement to the then-current Terms and Conditions. You agree to consult the Site regularly for up-to-date information about these Terms and Conditions and the Privacy Policy.

ENTIRE AGREEMENT

WAIVERS
